1. Introduction

These Terms & Conditions (“Agreement”) govern your use of the services provided by David O’Reilly – Coach & Writer. By accessing or using my services, you agree to be bound by these terms. If you do not agree, please do not use my services.

2. Purpose & Scope of Services

I provide coaching, mentoring, and educational services designed to support reflection, personal development, creativity, wellbeing, and goal clarification.

Services may include:

  • Personal development and reflective coaching - online and in person

  • Lifestyle and health coaching (non-medical)

  • Emotional well-being support (non-therapeutic)

  • Fitness coaching (non-medical)

  • Writing workshops, online programmes, and retreats

  • Progress and outcomes vary between individuals. No specific results are guaranteed.

3. Coaching Stance, Boundaries & Responsibility

While my work is informed by academic and professional training in lifestyle medicine, philosophy, positive psychology, literature, and coaching psychology, along with prior training in psychotherapy. This informs a psychologically aware and evidence-informed approach, while remaining non-clinical and non-therapeutic in nature. All services are educational, reflective, and supportive in nature. They do not constitute therapy, counselling, medical treatment, psychological services, or clinical intervention.

My work is grounded in a reflective, inquiry-based and non-directive approach. I use questioning and reflection rather than advice-giving, and I respect your autonomy, agency, and lived experience.

You acknowledge and agree that:

  • You remain the sole decision-maker in your life

  • Coaching does not replace your responsibility for decisions, actions, or outcomes

  • Any changes you make as a result of coaching are undertaken voluntarily and at your own discretion

  • Coaching is a collaborative process and does not guarantee specific results

4. Eligibility

To use my services, you must be at least 18 years old and capable of entering into a legally binding contract.

4.1 International Clients

By booking services from outside Ireland, you acknowledge and agree that these services are provided from Ireland and that Irish law applies to this Agreement and to any disputes arising from it.

5. Booking & Payment

Booking: Sessions are booked via my online calendar or by agreement.
Payment: Payment details will be agreed in advance and confirmed prior to any session taking place. Payment may be requested in advance depending on the nature of the service.

Pricing: Fees are agreed in advance following initial contact. Pricing may vary based on the nature, duration, or format of services and may take individual circumstances into account where appropriate.

6. Session Delivery
Sessions may be delivered online (via video call, phone, or other agreed platforms) or in person at a mutually agreed location. You are responsible for ensuring a suitable, safe, and appropriate environment for the session, whether online or in person.

7. Confidentiality

All information shared during individual sessions is treated as confidential.

Confidentiality may be breached only:

  • Where disclosure is required by law

  • Where there is a serious and imminent risk of harm to you or others

  • Where you provide explicit written consent

Confidentiality cannot be guaranteed in group settings, workshops, or retreats. Participants are responsible for respecting the confidentiality of others.

8. Limitations of Liability

To the fullest extent permitted by law:

  • I make no guarantees regarding outcomes or effectiveness of services

  • I am not liable for losses, damages, or consequences arising from decisions you make following coaching

  • My role is supportive and reflective, not supervisory, corrective, or clinical

Nothing in these terms limits liability where such limitation is prohibited by Irish law.

9. Trauma-Informed & Non-Clinical Support

I work in a trauma-informed and psychologically aware manner and may support clients who have lived experience of trauma, addiction, or recovery.

However, I am not a licensed therapist. My services are not a substitute for medical, psychological, psychiatric, or therapeutic treatment and are not intended for crisis intervention or acute mental health care.

While themes such as trauma, addiction, recovery, anxiety, or emotional distress may arise, I do not diagnose, treat, or provide clinical intervention for conditions including (but not limited to):

  • Depression

  • Anxiety disorders

  • Trauma-related conditions

  • Eating disorders

  • Addiction

Clients are encouraged to seek or maintain appropriate professional support alongside coaching where needed.

10. Recordings & Intellectual Property

All materials, written content, and resources provided remain my intellectual property.

  • Clients may not record sessions without prior written consent

  • Clients may take personal notes for their own use

  • Any recordings made by me will not be shared publicly without explicit consent

  • Materials may not be reproduced, distributed, or used for commercial purposes without permission

11. Cancellations, Rescheduling & Refunds

Sessions may be cancelled or rescheduled up to 24 hours in advance without charge.
Less than 24 hours’ notice will result in the session being charged in full.
No refunds are provided once payment has been made.

12. Governing Law & Jurisdiction

These Terms & Conditions are governed by and construed in accordance with the laws of Ireland.

Any disputes arising from or relating to these Terms, the services provided, or the relationship between you and David O’Reilly shall be subject to the exclusive jurisdiction of the Irish courts.

13. Changes to Terms

I reserve the right to modify these Terms & Conditions at any time. Continued use of services constitutes acceptance of updated terms.

14. Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, governmental actions, or technical failures.

WRITING & CREATIVE HEALTH RETREATS – TERMS & CONDITIONS

1. Nature of Retreats

Retreats, clubs and workshops focus primarily on optional wellbeing, creative and physical activities.

They are not medical, psychological, or therapeutic services and do not replace professional treatment.

Participants acknowledge that workshops and group discussion may evoke emotional responses and agree to take responsibility for seeking appropriate professional support if needed.

2. Booking & Payment

A non-refundable deposit is required to secure your place.
Full payment must be made at least 30 days before the retreat start date.

3. Cancellations

  • More than 30 days before the retreat: partial refund minus administration fee

  • Within 30 days of the retreat: no refund

  • If cancelled by the organiser: full refund or reschedule option

4. Assumption of Risk & Liability

Participants acknowledge that physical activities such as walking, hiking, swimming, rowing, or exercise involve inherent risk and agree to participate voluntarily.

To the fullest extent permitted by law, I am not responsible for injuries, losses, or damages to persons or property occurring during the retreat.

5. Medical Responsibility & Emergency

You confirm that you are medically fit to participate and will disclose relevant conditions or needs prior to booking.

In an emergency, assistance may be provided in obtaining medical care. All related costs remain your responsibility.

6. Travel Insurance

Comprehensive travel insurance is strongly recommended for all retreat participants.

7. Code of Conduct

Participants are expected to behave respectfully. Disruptive or harmful behaviour may result in removal from the retreat without refund.

8. Governing Law

These Retreat Terms & Conditions are governed by Irish law, with disputes subject to the jurisdiction of the Irish courts.

Nature of Blue52 Activities

Blue52 and related programmes are built around a structured weekly rhythm of optional activities including (but not limited to):

  • Sea swimming, walking, hiking, and outdoor experiences

  • Rowing, fitness, and movement sessions

  • Breathwork, yoga, and recovery practices

  • Shared meals, nutrition events, and social gatherings

  • Creative, writing, and reflective group sessions

  • Community and volunteering-based initiatives

These activities are designed to support lifestyle change, wellbeing, and social connection. They are not clinical, supervised, or individually prescribed interventions.

Participation & Personal Responsibility

You acknowledge that:

  • Participation in all activities is voluntary

  • You are responsible for assessing your own physical and mental readiness

  • You will participate within your own limits and exercise appropriate judgement

  • You remain responsible for your own safety, decisions, and actions at all times

No activity is mandatory, and you are free to opt in or out at your discretion.

Physical Environment & Outdoor Conditions

Many activities take place in outdoor or natural environments, which may include:

  • Open water (sea swimming)

  • Coastal or uneven terrain

  • Public or shared spaces

You acknowledge that such environments involve inherent and unpredictable risks, including weather, water conditions, and terrain.

Participation is undertaken at your own risk.

Group-Based Work & Community Setting

Blue52 operates as a community-based model involving group interaction, shared experiences, and social engagement.

You acknowledge that:

  • Group environments may involve differing perspectives, behaviours, and experiences

  • Emotional responses may arise during reflective or creative work

  • Confidentiality cannot be guaranteed in group settings

Participants are expected to behave respectfully and take responsibility for their own engagement.

Non-Supervised & Non-Clinical Model

Activities, sessions, and gatherings are not supervised in a clinical, medical, or therapeutic capacity.

David O’Reilly acts as a facilitator and organiser, not as:

  • A medical professional

  • A therapist or clinician

  • A safety supervisor for physical activities

You remain responsible for your own participation and wellbeing.

Health, Fitness & Lifestyle Activities

Where activities involve movement, exercise, or health-related practices:

  • You confirm that you are medically fit to participate

  • You accept the inherent risks associated with physical activity

  • You agree to seek medical advice where appropriate before participating

No monitoring, diagnosis, or treatment is provided.

Weekly Structure & Non-Obligation

Programmes may include a suggested weekly structure (e.g. scheduled activities, sessions, or themes).

WEEKLY CLUB / ONGOING PARTICIPATION

Blue52 and related weekly activities operate as an informal, community-based model rather than a fixed or structured programme.

Participation is flexible and self-directed. There is no obligation to attend any specific session, and access to particular activities may vary depending on circumstances, conditions, and availability.

All activities are non-supervised and non-instructional in nature. David O’Reilly acts as a facilitator and organiser, not as a supervisor, instructor, or safety provider.

Participants are responsible for their own decisions, conduct, and safety at all times, including in outdoor, group, and social settings.
